1.1. All rights, including copyright, in the Birdy’s Boutique’s website are owned or licensed to Birdy’s Boutique. Any use of the website or its contents, including copying, is strictly prohibited without prior permission from Birdy’s Boutique. Birdy’s Boutique is not liable for any loss or damage, which may happen from using any of the information or materials used in this website.

2. Definitions

3. Privacy

3.1. All information, items purchase and previous orders are all strictly confidential. Changes to this statement will be updated immediately. If an email address is given at any point through the ordering process or through other features on the Birdy's Boutique website this maybe added to our mailing list, if stated. However if you would like to unsubscribe at any time from Birdy's Boutique's newsletter or promotional emailers, simply email your name to us on help@birdys-boutique.co.uk, and state you would like to unsubscribed. Any data collected will not be passed on to third parties. Alternatively if you are a member of our website,when logged in, select My Account and under the heading E-Mail Notifications, select subscribe or unsubscribe accordingly.

4. Returns Policy

4.1. Cancellations / Customers Right to cancel
4.1.1. Order cancellations must be made in writing within 7 working days of placing your order, please quote your order number and send to our customer care email address: hello@birdys-boutique.co.uk. This does not apply to items that can not be returned. Please check our Terms and Conditions and product information clearly before ordering.
4.2.2. To cancel an order that has not been delivered email hello@birdys-boutique.co.uk. If your order has already been sent, you will need to return the order to us first. Please see 4.2.1.

4.2. Return or Exchange
4.2.1. If you are not completely satisfied with your purchase, please return the order to us in their original condition within 7 days after delivery with the return slip. Items returned without a return number will not be processed. We will issue a full refund (excluding delivery charges) on receipt of the returned item(s), or exchange the item for a different size / colour if preferred. All items must be unworn, with tags & fit or re-sale, they must be returned in secure & protective packaging.
4.2.2. Some products are non-returnable. This maybe stated on the items page, but includes all earrings & studs for hygiene reasons & any personalised items. Until the order reaches us we are unable to refund or exchange any items. The cost of returning item(s) is the customer’s responsibility and will be until the item reaches us. We strongly recommend using a reputable postal firm, ask for a postal receipt or proof of postage & insure your items.  We can only exchange items for a different size or colour. If you would like a completely different product
we will refund the original order as detailed above & process another order. Exchanges may take 7 working days or longer, we will notify you of any delays. If the items purchased entitle you to a free gift, the gift must be returned with the item.
4.3.3. Any end of season sale makes the items non-returnable, they are sold as seen. Only an exchange can be issued.
4.3.4. STORE RETURN POLICY. If you change your mind about your purchase, please return the unused goods to us with the original till receipt within 21 days, and we will offer you an exchange or a credit note. This does not affect your legal rights, including your right to claim a refund, replacement, repair and/or compensation where the goods are faulty or misdescribed. Under the Sale of Goods Act 1979. Please note if you do not have your recipt, a bank statement will be sufficient. We will need a proof of purchase to confirm the date the item was purchased & the price paid for the item. Please note this is in accordance with SOGA. (Sales of Goods Act).



4.3. Faulty Items
4.3.1. If the item you received is faulty, please contact customer care on hello@birdys-boutique.co.uk quoting your order number, your name and address, details of the product and the reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. You have 30 days from receipt of the faulty item to return it to us. Please see 4.2.1 for more details.
4.3.2. STORE FAULTY ITEM POLICY. If you have purchased an item from Birdy's Boutique and the item is faulty or has developed a fault, please reutrn the item with the orginal receipt or proof of purchase and preferably with the original tags.
Please note an item is not classed as faulty if the following occur: Fair wear and tear, accidental damage or misuse of the item, if you don’t want the item any more, for example it is the wrong size or colour, if you knew the item was faulty when you bought it, if you misused the item and caused a fault, If you tried to repair the item or had someone else try to repair it, which damaged the item. Please return the faulty item to us with the original till receipt and we will offer you a replacement, exchange, credit note, offer of repair or refund. This does not affect your legal rights. Under the Sale of Goods Act 1979. Please note if you do not have your receipt, a bank statement will be sufficient. We will need a proof of purchase to confirm the date the item was purchased & the price paid for the item. Please note this is in accordance with SOGA. (Sales of Goods Act).

4.4. I've received an item I did not order /I received the wrong item
4.4.1. If the item you received is not what you originally ordered, please contact customer care quoting your order number, your name and address, details of the product and the reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. hello@birdys-boutique.co.uk.

5. Packaging

5.1. All items are carefully packaged, using tissue paper & in some cases plastic bubble wrap where items are likely to be damaged during delivery, however if you are allergic in anyway to certain wrapping materials or would not like your item packaged in this way, please feel free to email us with a special request and this will be dealt with for you.

5.2. Allergies

5.2.1. If you are allergic to any materials and are unsure about a Birdy's Boutique product please contact us before purchase.

6. Deliveries

6.1. Royal Mail – UK Delivery: £1.99 - UK Standard Royal Mail 2-5 working days.
6.2.
Europe & Worldwide Delivery: £3.99 - We currently post to the following countries:
United States, Canada, Mexico, Australia, New Zealand, Japan, Hong Kong, France, Germany, Greece, Hungary, Belgium, Denmark, Finland, Cyprus, Italy, Malta, Turkey, Switzerland, Sweden, Portugal, Spain, Norway, Netherlands, and Ireland.
6.3.
Out Of Stock If you would like to order an item we do not currently have in stock, we maybe able to re-order the item(s) in the colour, size and style you require - in this case you will be notified, please allow an extra 2 - 4 working days for delivery.
6.4. Special Jewellery Love From Hetty and Dave Jewellery & other brands we stock may take longer to be delivered as the items are all handmade. Please contact us for more details.
6.5.
If there any problems with not receiving an order please email help@birdys-boutique.co.uk & we will track your item & let you know the arrival date.

7. Missing / Stolen Parcels

7.1. Birdy’s Boutique can not be held responsible for missing or stolen parcels. However we will help as much as possible to track down any items. Insurance can be taken out for your parcels for a small fee, if you would like any information on this, please contact us.

8. Payment

8.1. We use PayPal, please email hello@birdys-boutique.co.uk. PayPal information is available at www.paypal.com.
8.2.
Prices on the website are all inclusive of VAT and are correct at the time of entering the information.

9. Products

9.1. Birdy’s Boutique describes all products listed in the clearest form and can not be held responsible for misinterpretation. Birdy’s Boutique tries to make all products as clear as possible, however colours can vary depending on your monitor.
9.2.
We can not guarantee all colours are accurate. We reserve the right to refuse any orders where product information has been entered incorrectly on our website regardless of promotional activity. Prices are subject to change and without notice.
9.3.
All products on the Birdy’s Boutique are subject to availability If an item you have ordered is out of stock before your order is accepted, we will contact you as soon as possible, in most cases this should not affect your order or order delivery time. However it may lengthen the delivery time, in this case we will notify you.

10. Abuse

10.1. We are happy to help any customers but we do not accept any abusive emails at Birdy’s Boutique, the user will be banned from the site and any future use.
